1. Acceptance of These Terms
These Terms & Conditions ("Terms") are a binding agreement between you and FareGoal, LLC ("FareGoal," "we," "us," or "our") governing your access to and use of the FareGoal website at faregoal.ai, and any related applications, emails, alerts, and services we provide (collectively, the "Service").
By creating an account, joining our waitlist or beta, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
2. The Service
FareGoal is a flight price monitoring and trip planning tool. The Service allows you to:
- Create "watches" for flights by specifying an origin, destination, travel dates, and a goal price;
- Receive email or in-app alerts when fares reach your goal price or change meaningfully;
- Review fare history, price suggestions, and weekly digests;
- Browse and explore destinations by price, month, and interests; and
- Plan trips using itinerary and budget tools.
FareGoal is an informational tool only. We do not sell flights, issue tickets, process travel bookings, or act on your behalf with any airline or travel provider.
3. Eligibility & Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.
When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for all activity that occurs under your account and for keeping your login credentials secure. Notify us promptly at the contact address in Section 19 if you suspect unauthorized use of your account.
4. Beta Access
Parts or all of the Service may be offered on an invite-only or "beta" basis. Beta features are provided for evaluation purposes, may contain errors, may change or be discontinued at any time without notice, and are provided "as is" without any warranty of any kind. We may limit, revoke, or condition beta access at our sole discretion.
5. Fare Data & Alerts
Fare prices, availability, fare histories, and price suggestions displayed or sent by the Service are collected from third-party sources and refreshed periodically — not continuously. Airfare changes rapidly and without notice. Accordingly:
- Prices shown in the Service or in alerts may be outdated, incomplete, or inaccurate by the time you see them;
- A fare shown or alerted may no longer be available when you attempt to book it with an airline or travel seller;
- Goal-price suggestions, digests, and budget estimates are informational estimates only, not guarantees or advice; and
- Alert delivery depends on third-party systems (including email providers) and is not guaranteed to be timely or uninterrupted.
Always confirm the final price, fare rules, taxes, and fees directly with the airline or travel seller before booking.
6. We Are Not a Travel Agent
FareGoal is not a travel agency, ticket seller, airline, or booking intermediary, and is not affiliated with or endorsed by any airline. Any booking you make is a transaction solely between you and the airline or travel seller, subject to their terms and policies. We have no responsibility for bookings, cancellations, schedule changes, refunds, baggage, or any other aspect of travel you purchase from third parties.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Scrape, harvest, or systematically extract data from the Service, or access it by automated means (bots, crawlers, scripts) except through interfaces we expressly provide;
- Resell, sublicense, or commercially redistribute the Service or its data without our prior written consent;
- Reverse engineer, decompile, or attempt to discover the source code or underlying data sources of the Service;
- Interfere with or disrupt the Service, its servers, or its security features, or circumvent access or rate limits;
- Create accounts by automated means, share accounts, or misrepresent your identity; or
- Use the Service to send spam or unsolicited communications.
8. Intellectual Property
The Service — including its software, design, text, graphics, logos, and the selection and arrangement of its content — is owned by FareGoal or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms. No other rights are granted. "FareGoal" and associated logos are trademarks of FareGoal, LLC.
9. Feedback
If you send us ideas, suggestions, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose without compensation or attribution.
10. Third-Party Services
The Service may display fares from, or link to, third-party websites and services, including airlines and travel sellers. We do not control and are not responsible for third-party content, products, or services. Your use of third-party sites is governed by their own terms and privacy policies.
11. Fees
The Service is currently offered free of charge during beta. We may introduce paid plans or features in the future. If we do, we will disclose pricing and billing terms before you incur any charge, and continued use of paid features will require your agreement to those terms.
12. Suspension & Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 8, 9, 13, 14, 15, and 16) will survive.
13. Disclaimers
This section limits our legal responsibility. Please read it carefully.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. FareGoal does not warrant that the Service will be uninterrupted, timely, secure, or error-free; that fare data, alerts, estimates, or suggestions will be accurate, complete, or current; or that any fare shown will be available for purchase. You use the Service, and make travel and purchasing decisions, at your own risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
14. Limitation of Liability
To the maximum extent permitted by law, FareGoal and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, missed fares or travel opportunities, loss of data, or loss of goodwill, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars (US $100).
Some jurisdictions do not allow the limitation of certain damages, so some of the above limitations may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless FareGoal and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Utah, and you consent to personal jurisdiction and venue there.
To the extent permitted by law, you and FareGoal each waive any right to a jury trial and agree that any claim must be brought individually, and not as a plaintiff or class member in any class or representative proceeding.
You must bring any claim relating to the Service within one (1) year after the claim arose, or it is permanently barred, unless a longer period is required by applicable law.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. The "Last updated" date above reflects the current version. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
18. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and FareGoal regarding the Service and supersede any prior agreements. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any partnership, employment, or agency relationship.
